TRAVEL CONTRACT

1. Bookings

Bookings are understood accepted when:
- Leopolda Travel has issued a file code.
- Leopolda Travel has confirmed the final price of services.
- Leopolda Travel has received the required deposit.
Copy of the bank transfer must be sent by fax to Leopolda Travel 0039 10 5303758 within 48 hours of the confirmation.
Any delay will result in the cancellation of the services.
It is the  responsability of the client to check all details on the confirmation carefully to ensure they are correct as this forms the basis of the contract.

2. Time of arrive and departure

The rooms and properties are generally available from 2.00 p.m.
On the day of departure you should vacate the property before 12.00 noon .

3. Currency 

The prices are quoted in EURO.

4. Payments

We  accept only payments in Euro by bank transfer to the following account:

Booking deposit: at the booking time a deposit of 25% of the total is required. Balance: must be paid within 30 day before the arrival date.
If the balance is not received in full by the due rate we reserve the right to cancel your booking in which case the cancellation charges as set out in clause 5 will be charged .

5. Late bookings

Bookings made within 30 days of arrival are deemed as late bookings. Full payment will be due immediately and once we have received it, all booking conditions will apply. Should you cancel after this point, for whatever reason, cancellation charges as shown in clause 7 will apply. Late booking will be subject to a supplement of 13 Euro if documents must be delivered by courier .

6. Holiday documents

The dispatch of your holiday documents are conditional on the receipt of the balance according to the terms stated in article 3.

7. Transferability

The Traveler that is unable to comply with the confirmed booking can cede his own booking to another person that satisfies all the requested conditions for the service.
The new Traveler will only pay a penality of 50 euro and the arrangements will remain exactly the same as the original booking.
In this event, the Traveler must inform Leopolda Travel within a minimum of 15 days of foreseen arrival date. Leopolda travel is not responsible for the missing acceptance of the new nominative and third party service suppliers.
The surrendering Traveler and the new Traveler are both responsible for the payment and any additional resulting expenses.
If you wish to transfer your booking to another product thereby changing the arrangements completely, this will be treated as a cancellation with resulting charges as set out in clause 7 if applicable. It will be necessary re-book another holiday .

8. Cancellation by you

If you cancel your holiday the lead name on the booking must advise us by post or fax immediately. Verbal cancellations or cancellations by email will not be accepted. If you cancel your holiday, you will be liable to pay the cancellation charges set out in the table below .

Cancellation periods are calculated on the date of your cancellation received  at our offices or fax. As per Art. 1373 III Paragraph of the Italian Codice Civile the Traveler must pay the amount indicated below:Cancellation received before arrival date. Cancellation charge expressed as a % of total holiday cost
a) 30 working days before departure:            Penalty  30%
b) 29 to 15  working days before departure    Penalty  50%
c) 14 to departure                                        Penalty 100%

- If you cancel your holiday on the day of arrival due to circumstances beyond our control, compensation or refunds will not payable by us and any such claims should be forwarded to your insurers ;
- Should you decide to curtail your holiday arrangements, for any reason, no refunds will be payable for any unused nights of accomodation;
- The applicable cancellation charges must be paid even if you have not yet paid the full cost of your holiday for any reason;
- The applicable cancellation charges must be paid even if you decide to change your reservation to another property for any reason and without explicit authorisation of Leopolda Travel.

9. Alteration and cancellation by us

The Traveler can cancel the booking without paying the amount above stated in the preceding clause, if modification has been done by Leopolda Travel that is:
- More than a 10% increase of the total price of the confirmed accomodation on the confirmation date;
- Arrival and/or departure date change beyond 48 hours of original booking;
- Reduction of category of the confirmed accomodation.
The Traveller will be offered the option to either rescind the contract and be refunded payment or will be offered the following:
-- an alternative tour package or service of the same or higher price without an additional supplement
--- an alternative tour package or service of a lower price with a refund of the difference The Traveller will be notified of the changes and must accept or reject them within 48 hours, or 2 working days from the notification. In absence of communication by the customer, the modification will be understood as approved.
We may occasionally have to cancel your holiday as a result of an act of God that is any occurrence outside our control and which could not have been avoided with all due care. Such events may include war or threat of war, riots, civil strife, terrorist activity, natural or nuclear disaster, government action, adverse weather conditions and all similar events out of our control. In this situation, we regret we cannot make any refunds, meet any costs or expenses you may incur as a result or pay any compensation .

10. Our responsability

As a Tour Operator the responsibility of Leopolda Travel towards the Travelers, and their belongings, is regulated by the laws and  international conventions concerning  Tour Operators’ responsability (law n. 1084 of 27/1271977, ratification of the International Convention of Brussels of 23/04/1970) valid from the moment of verification of aforementioned responsibility.  The responsability of Leopolda Travel cannot, in any case, exceed the scheduled limits from the applicable laws and conventions and more particularly the limits for individual damage as specified in the following: 2) Damages to the person of the Traveler (death, injuries or illness), unless it is proved that it is due to  the negligence of our employees, or your appointees, i.e. from the third parties lenders of service(s) during the vacation. The responsability of Leopolda Travel for said damages cannot, in any case, exceed the measure defined by the Convention of Bruxelles of the 1970 (ratified with law n. 1084 – 27/12/1977).
3) Damages, loss, theft, relative to belongings owned by the Traveler (i.e. baggage), resulting from the breach and/or bad execution of the service(s) confirmed, by Leopolda Travel or by his appointees (third parties) lenders of services. The responsability of Leopolda Travel cannot exceed the limits of the International Conventions regarding the service within which the harmful event has been verified and the sum of  30% of the value of the service confirmed for each Traveler.
4) Leopolda Travel will not be in any case responsible for damages, of any kind, when the breach or bad execution of the contract is not imputable either to its negligence, not the negligence of guilt or either supplier of service(s), due to the ascertained lack in the execution of the contract, that:
   1 are imputable to the Traveler;
   2 are imputable to a third party extraneous to the supply of the service(s) and present an unpredictable or insurmountable character;
   3 are due to causes of  “Acts of God” or to an  event that Leopolda Travel or the supplier of the service(s) in question, could not, even  with all due care, foresee and avoid.
5) Leopolda Travel  will not be in any case responsible of the damages:
   1 consequent to the omission, by the Traveler, of recommendentions or instructions of Leopolda Travel or the supplier of the service(s);
   2 due to services furnished by third parties and not mentioned at the moment of the  booking confirmation;
   3 due to autonomous iniziatives of the Traveler.
6) If, in the opinion of any person in authority such as Police, accomodation owner,  manager or Leopolda Travel employees, you appear to be unfit to occupy your accomodation or because of anti-social behaviour are likely to cause a disturbance to other guests or damage to property, we may terminate your holiday arrangements with us. We will not be liable to make alternative arrangements for other accomodation nor we will cover any costs which you may incur or make any refunds.
7) All services and facilities offered by us are subject to the standard terms and conditions of the Supplier and are  incorporated into our contract with you.
A damage deposit and telephone deposit are usually payable to the accomodation manager or owner to protect against possible damage and outstanding telephone charges when there is a telephone available in the room.  Deposits are normally returned on departure if there is no damage. 
You are responsible for ensuring that any accomodations are left in the same conditions of cleanliness and repair as upon arrival. Any loss or damage caused by you will be deducted by the Owner from your damage deposit.
Property Owners reserve the right to refuse admittance if the number of persons arriving exceeds the number on the booking form or the maximum sleeping places as detailed in the web site. Where a property offers a price for varying numbers, empty bedrooms will be closed.

11. Complaints

In the event that you are dissatisfied with any aspect of your chosen accomodation you must immediately report the cause to the keyholder or Owner of the villa or supplier and Leopolda Travel who will endeavour to put things rights.
In the unlikely event that you are still not satisfied upon your return from your holiday, you must write us giving full details within 10 days.
If you fail to notify us or the Supplier of any dissatisfation during your holiday we cannot accept liability for that compliant in retrospect.
If you leave your accomodation prematurely without an explicit authorisation of Leopolda Travel, you forfeit your rights for a refund. Such complaints will not be taken into consideration.

12. Rates

The rates quoted are based on the cost program as of 01/01/2006. In case price changes occur in accomodations and services, the rates will be modified, in increase or in decrease, according to the variations.
However, the price defined in the confirmation document will not change in the 15 days before the arrival date. The customer has the right to cancel the booking in case of a price increase greater than 10% as per clause 8.
The customer  accepts the price at the beginning of the contract.  No further negotiation of price will be considered after the completion of the travel package.

13. Valid documents for Travel Abroad

The customer is responsible to hold all valid documents for travel abroad. Leopolda Travel is not responsible for inaccuracies or lack of valid travel documents.

14. Law and jurisdiction 

This contract is governed by the law of Italy and exclusive jurisdiction is conferred on the Italian Courts.
Your booking with Leopolda Travel implies that all clauses of this contract have been understood and have thereby been accepted without reservation and exception.

15. Hotel and Bed and Breakfast Classification 

The recognized official classification by the National Italian Tourist Board in addition and/or absence, a quality judgement based on the established criteria of the organizer.

16. Insurance 

Leopolda Travel has Insurance Coverage with Europ Assistance n. 4379960 according to the legislative decree 111 dated 17/03/1995.
And Insurence Guarantee Fonf “Fondo vacanze Felici”.

19. Data Protection Policy

In order to process your booking we need to use the information
you provide such as name, address, and special needs requirements.
We take full responsability for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of the accomodation (except credit card details), and if required by them or by law, to security or credit checking companies and public authorities such as customs/immigration. We will not pass any information on to any person not responsible for part of your travel arrangements.

Mandatory notice 
Italian law punishes the crimes inherent to prostitution and  juvenile pornography with the punishment of the imprisonment, even if it has been committed in foreign countries ref. Law n. 269, 3 august 1998, art. 16.
